Divorce Lawyer: Do Not Even Think About A Do It Yourself Divorce!

If you are planning a do it yourself divorce, then you are headed for trouble.

Where there is significant property or children involved, divorce is simply not a “do it yourself” project.  Complicating factors such as the value of property or the determination of custody and access to your children make a “do it yourself online divorce” a very risky proposition.

Instead, you should consider hiring a divorce attorney to represent your best interest.  Read further to learn why you need a divorce lawyer and how this type of family lawyer can best represent your interests.

Division Of Property And Assets

One of the main issues that arises from the moment the divorce papers are served is is the division of property.

Typically, having more property can make the divorce much more difficult.  In dividing the property, you must look at the fair market value of real estate and investments at the time of the divorce.  With respect to businesses, the valuation is much more difficult because the skill or expertise of one spouse or the other contributes greatly to the value of the business.

As much as you should be concerned about division of property, custody is an even bigger concern if there are children in the marriage.

Custody And Support

Children typically constitute the greatest complicating factor in a divorce proceeding.

Because of the emotions involved, parents do not always act rationally or in the best interest of the children.  Issues, such as possession and child support, should be resolved by determining what is in the children’s best interest.  Remember, they did not ask for the parents to get divorced.

In addition, where the children are older, they should be given a voice as to their preferences for custody and possession.  In some states, older children have this right by statute.

Because of the complicating factors involved, it is clear that where there are children, a “do it yourself online divorce” is out of the question.

The stakes are simply too high.

Hire An Experienced Divorce Attorney

Where there is significant property and/or custody issues involved, it is important that you contact a competent divorce lawyer.  You can look for an attorney that handles divorce online, or you can the recommendation of a friend or relative.

Unlike most pro bono lawyers lawyers, a divorce lawyer possesses the expertise and experience to recognize and resolve the peculiar issues that come up during a divorce proceeding.  Divorce attorneys assist in the discovery, valuation and division of the marital estate.

Their goal is to ensure that you are treated fairly.

More important, the family lawyer will help you incorporate a custody, possession and support order into the divorce papers that will ensure that the children are treated with the dignity and respect that they deserve.

A divorce lawyer is essential to protect your interests and those of your children during a time where you may not be thinking or acting rationally.

Protect Your Interest And Those Of Your Children

Do you see what I mean about a do it yourself divorce?  Now that you know a bit more about what to expect during a divorce proceeding, it is clear that where there is significant property or children, you need to hire a divorce attorney.

Property valuation issues can be tricky and lead to an unequal division of property.  Custody issues are wrought with emotions and child support must be calculated fairly.  When you are dealing with either (or both) of these issues, hiring a divorce lawyer is the best option for you.

If you weigh the risks involved, you will find that, in the end, hiring a divorce lawyer is a wise investment of your time and money.

I have to agree with you 110%. I practice divorce law and can tell you that there’s nothing worse than someone coming to see you AFTER they have made a bad deal for themselves and their children. It’s much easier and less expensive to hire someone up front rather than hiring someone to “fix” things after the fact.
