First and second dui offenses have lower penalties as compared to third and fourth offenses. Third offense corresponds to a minimum prison sentence of one hundred twenty [120] days of jail time or returned into a home arrest or a possible rehabilitation. This penalty is even lower as compared to other counties that requires at least two hundred [200] days or a one [1] year jail time.
The probation is the same as first and second offense which is three [3] to five [5] years. The california dui class is intended to correct and help the patient.
