Use An Eviction Attorney For Evicting A Tenant

Many investors think that owning a rental property is going to be easy.  Everyone is going to pay their rent on time and nothing in the property will break.  Unfortunately, that is not the truth.  Just like your own house, mechanical items fail and parts of you home need to be maintained.

Tenants also don’t always pay their rent.  You need that rent as that is your income.  Just like owning a store, these are your sales.  The expenses don’t stop when the tenant doesn’t pay their rent.  So what do you do about it?

As a landlord, you will eventually need to evict a tenant for non payment of rent.  Here are some tips and tricks to doing that:

  • Do not wait too long to start the eviction.  Most landlords will believe excuse after excuse from the tenant and will eventually start the eviction after the tenant is into their second month of nonpayment of rent.  Don’t let it get that far.  Regardless of whether you are going to start the eviction on the 6th, 16th, or 26th, make sure that you set a rule of policy and always follow it.  If you start the eviction on the 6th and the tenants pay you on the 7th, great.  Cancel the eviction and move on.  At least you were prepared and they know you were serious.
  • Use an eviction attorney if you aren’t objective enough to do the work.  It may cost some money, but it will be less stress on you.
  • When you get to court, do not give the tenant a lot of extra time to pay their back rent.  Again, less experienced landlords will allow the tenant to stay in the property for weeks and pay them back slowly.  The tenant has had several weeks to know they are past due on paying their rent.  Why do you think that another couple weeks is going to get them to pay?

Being firm, but consistent about the eviction is probably the most important part of being a landlord.
